Terms of Service

These terms apply to any project undertaken by Atomic Web Design ("Atomic", "we", "us"), Company No. 15603201, Brighton & Hove, UK, for a client ("you"). They take effect once you accept a written quote or proposal from us, at which point they form the agreement between us for that project.

Our services

We provide branding, website design and build, and related business launch services, either as one of our standard packages (Atomic Starter, Atomic Business, Atomic Business Plus) or as a bespoke project. In every case, the exact scope, deliverables and price are confirmed in writing before any work begins, and that written quote takes precedence over the general package descriptions on this site.

Payment

• A 50% deposit is due before work begins, with the remaining balance due before launch or on delivery of the final files.
• Payment plans are available on our larger packages — the schedule will be agreed and confirmed in writing before the project starts.
• Invoices are payable within 14 days unless otherwise agreed. We may pause work on overdue accounts.
• All prices are exclusive of VAT unless stated otherwise.

Project scope & changes

Work is carried out according to the scope set out in your written quote. Two rounds of revisions are included at each design stage (brand, then website); further rounds, or requests outside the original scope, will be quoted separately before we proceed. Timelines depend on us receiving your content and feedback promptly — delays on your end may push back the delivery date.

Cancellation

You can cancel a project at any time by telling us in writing. If work has already started, the deposit covers that work and isn't refundable; any balance owed for completed work will still be due. If we need to cancel a project, we'll refund any payment for work not yet carried out.

Ownership

Once you've paid in full, ownership of the final website files, code, and brand assets we create for you transfers to you. Before that, and for anything not paid in full, these remain our property. Some elements — such as licensed stock photography, fonts or third-party plugins — remain subject to their own licence terms and may not be fully transferable. We may display completed projects in our own portfolio and marketing unless you ask us not to.

Support after launch

Every package includes a period of free support after launch, as set out in your package or quote, to fix any issues with the work we delivered. Ongoing hosting, maintenance, and content changes beyond that are covered by an Atomic Care plan, if you choose to take one out.

Liability

We'll carry out our services with reasonable care and skill. Our liability to you for any claim relating to a project is limited to the fees you've paid us for that project, and we're not liable for indirect or consequential losses. Nothing in these terms limits our liability where it would be unlawful to do so, including for death or personal injury caused by negligence, or for fraud.

Governing law

These terms are governed by the laws of England and Wales.

Changes to these terms

We may update these terms from time to time; the version in place when you accept a quote is the one that applies to that project.
